GENERAL TERMS OF SALE / SUBSCRIPTION
Collaborative Platform “Caderno do Empreendedor” by BIZDEIA (Eibizion brand)

1 – OBJECT
1. These general terms of sale are intended to provide and define all necessary information for the User regarding the ordering, sale, payment and delivery procedures for purchases made on the Platform www.cadernodoempreendedor.com.
2. These terms regulate all stages required for the subscription and ensure its follow-up and the provision of the service between the Contracting Parties.
3. These general terms shall not apply if, due to the type of subscription, the User is not a final consumer as defined in point c) of article 3 of Decree-Law no. 24/2014, of 14 February.
2 – SUBSCRIPTION
1. The User completes the subscription through the purchase process designated on the Platform www.cadernodoempreendedor.com as “checkout”, after adding the product / service to the shopping cart, by selecting the option “buy or subscribe”:
a) from the online catalogue presented on the website www.eibizion.com or on the Platform www.cadernodoempreendedor.com;
b) from partner websites with which BIZDEIA (Eibizion) may have or may come to have such partnerships.
2. To submit the order, the User must:
a) Register on the Platform www.cadernodoempreendedor.com, providing the information requested there for this purpose. (See our Privacy Policy)
b) Log in (providing a combination of e-mail and password chosen by the User during registration).
c) Complete the information and choose the options made available throughout the checkout process (delivery and billing address; shipping method; payment method, as well as the tax number and the name which, for tax purposes, the User wishes to appear on the invoice).
3. Final confirmation of the subscription by the User is equivalent to full and complete acceptance of the price and description of the service available for sale, as well as of these General Terms of Sale, which shall be the only terms applicable to the contract thus concluded.
4. BIZDEIA/Eibizion will honour online subscriptions received only up to the limit of the subscribed period. In the event of lack of accessibility to the service, BIZDEIA/Eibizion undertakes to inform the User as soon as possible.
5. The data contained in the invoice are the sole responsibility of the User. Once issued, the invoice cannot be reissued with changes.
6. Subscription requests are valid for 15 (fifteen) days, unless the subscription is registered under a promotional campaign defining a different period, and it is not possible to guarantee the price, discount, promotion or offers beyond this period. If payment is not received by our services within that period, the subscription cannot be validated. Any amount received after this date will be returned in the form of a voucher, which may be converted into a bank transfer or used for a new order of the company's products or services.
3 – PAYMENT
1. On the website www.eibizion.com or on the Platform www.cadernodoempreendedor.com, BIZDEIA/Eibizion offers the User the following payment methods:
a) Credit card (Visa, Mastercard and Eurocard);
b) PayPal,
c) MB Way,
d ) Bank transfer.
2. The User shall pay a global amount corresponding to the value of the subscribed product / service, which shall include information and customer support.
3. In the case of payment by credit card, the debit will be made on the User's card immediately after the subscription is registered. If any subscription is unavailable, its value will be credited to the User's card after the subscription is closed.
4. BIZDEIA/Eibizion will make every effort to ensure maximum confidentiality and security of data transmitted via the internet.
5. BIZDEIA/Eibizion informs that the payment made by the User is received by BIZDEIA Unipessoal Lda.
4 – SUBSCRIPTION AVAILABILITY
1. The subscription is made available after payment, except for some exceptions defined or decided by BIZDEIA/Eibizion.
2. BIZDEIA/Eibizion undertakes to make the Platform www.cadernodoempreendedor.com available as quickly as possible.
3. The availability periods stated in the product sheet correspond to the period of time in which the product/service becomes ready for availability from the moment of its subscription and are based on the history of past accesses to this product/service, and therefore should be considered merely indicative, thus not guaranteeing future accesses.
4. BIZDEIA/Eibizion will always endeavour to comply with the availability periods, informing the User if it foresees difficulty in meeting them, in which case it will provide the User with the option to terminate the subscription or the contract. By not exercising this right, the User assumes that they maintain interest in the subscription and consent to availability beyond the stated period.
5. To follow the progress of an ongoing subscription, the User must consult the Platform www.cadernodoempreendedor.com, or contact by telephone, e-mail, or form on the platform or on the website.
6. The total estimated time for making the subscription available shall correspond to the longest of the service availability periods, plus the time required for processing it, namely:
Subscription Processing = Service Availability + Communication.
Availability means the period of time in which the product/service becomes ready for use. Availability is only guaranteed after confirmation of payment has been communicated to us.
The total availability time will depend on the day and time.
5 – PRICES
Prices vary between B2C and B2B, that is, subscriptions or contracts depending on whether the customer is a final consumer or an institution, and also according to negotiation.
6 – DISCOUNTS
On the Platform www.cadernodoempreendedor.com, discounts vary according to the number of users of an institution and the type of final consumer.
7 – WARRANTIES
1. Any subscription contract made through the website www.eibizion.com or the Platform www.cadernodoempreendedor.com may be freely terminated under article 10 of Decree-Law no. 24/2014 of 14 February. For this purpose, the User must renounce the Product/service within 30 (thirty) days after subscription.
2. The return process is simple, but varies according to origin, and therefore the User must previously contact BIZDEIA/Eibizion by e-mail or through the form or website www.eibizion.com.
3. BIZDEIA/Eibizion accepts any subscription renunciation, with the User being responsible for the administrative costs of renunciation. If a renunciation is accepted, BIZDEIA/Eibizion undertakes to reimburse the User for the amount paid for the subscription, minus administrative expenses, within a maximum period of 30 (thirty) days from receipt of the renunciation information.
4. Returned products must necessarily be in saleable condition, that is, in the same condition in which they reached the User, without any anomaly or damage.
5. If the value resulting from the exchange of products in an order is higher than the initial value of that order, the User must pay the difference, using one of the payment methods available in no. 1 of article 3.
6. If the value resulting from the exchange of products in an order is lower than the initial value of that order, or in the case of return, the refund will be made through a shopping voucher, valid for 6 months, made available in the Customer Area, which may be converted into a bank transfer to the account indicated by the User.
7. If the value resulting from the exchange of products in an order is lower than the initial value of that order, or in the case of return, the refund will be credited directly to the User's card account, if the payment method is Credit Card or MBWay.
8. Products sent free of charge, in the form of gifts or bonuses, will not be refunded.
9. The User may not exercise the right of free withdrawal provided for in article 10 of Decree-Law no. 24/2014 of 14 February in the cases provided for in points c) and l) of article 17 of Decree-Law no. 24/2014 of 14 February, namely:
a) Clearly personalised products (e.g. signed books);
b) Products personalised for individuals, companies or institutions (special orders or products).
10. In the event of a dispute, the consumer may resort to an Alternative Consumer Dispute Resolution entity:

8 – COMPLAINTS
The User may submit suggestions or complaints to BIZDEIA/Eibizion by e-mail or through the form on the website www.eibizion.com.
9 – LIABILITY
BIZDEIA/Eibizion shall not be liable for any inconvenience or damage caused to the User by the use of the Internet network, such as: service interruption, external intrusion, anomalies caused by computer viruses or any other case of force majeure.
10 – COMMUNICATIONS
1. Under Decree-Law no. 7/2004, of 7 January, and Decree-Law no. 41/2004, of 18 August, BIZDEIA/Eibizion sends, based on the data collected during the User's registration, the following communications:
a) Communications of a merely informative nature, namely: sending documentation relating to transactions carried out, information on the status of orders, messages promoting articles and initiatives to promote products and initiatives and events, presentations or workshops;
b) Communications of an advertising nature, whose nature and promotional advantages contained therein will be clearly identified so as to be identifiable by an ordinary recipient.
2. BIZDEIA/Eibizion provides the User with the possibility of refusing, at the time of the respective collection or at any time, the use of their electronic contact details for communications of an advertising nature.
11 – PERSONAL DATA PROCESSING
The User authorises BIZDEIA/Eibizion to process automatically the personal data provided when using the website www.eibizion.com, in particular through the use of cookies. (See Privacy Policy)
12 – INTELLECTUAL PROPERTY
1. All content on the Platform www.cadernodoempreendedor.com is the intellectual property of BIZDEIA Unipessoal Lda., and may not be copied or reproduced, except to the extent strictly necessary to allow its online reading.
2. The content on this Platform is produced by internal and external sources, and therefore BIZDEIA/Eibizion is not responsible for the lack of updating and/or inaccuracy of such information.
3. All texts, images, illustrations, photographs, trademarks and other elements of the Platform www.cadernodoempreendedor.com are protected by law.
4. A User who has a website on the Internet and wishes to place, for personal use, a link directly referring to the website www.eibizion.com or to the Platform www.cadernodoempreendedor.com of BIZDEIA/Eibizion must request authorisation for this purpose, which authorisation may under no circumstances be considered as an implicit affiliation agreement.
5. All links referring to the website www.eibizion.com or Platform www.cadernodoempreendedor.com using framing or inline linking techniques are formally prohibited.
13 – TRANSACTION STORAGE AND ARCHIVING
Orders / subscriptions and invoices shall be archived on a reliable and durable medium so as to correspond to a faithful and durable copy.
14 – EVIDENCE
The Parties agree that computerised records, kept in BIZDEIA/Eibizion's computer systems under reasonable security conditions, constitute proof of the communications, orders and payments made between the parties.
15 – APPLICABLE LAW AND COMPETENT COURT
1. The law applicable to any contractual relationship established through the Platform www.cadernodoempreendedor.com or the website of BIZDEIA/Eibizion is Portuguese law.
2. In the event of a dispute arising from the interpretation, application and/or termination of any Contract entered into under these General Terms of Sale, as well as for any actions intended to demand performance, its amendment, total or partial annulment and/or termination, or for any other actions based thereon, the Parties elect, by mutual agreement and because this agreement is in their interest, the Civil Court of the District of Porto as the competent court, expressly waiving any others that by law would be territorially competent, or, alternatively, the Alternative Dispute Resolution entity(ies) referred to above, as agreed between the Parties.
